CONDITIONS, RULES, AND ACCEPTABLE USE AGREEMENT:Free World U has actively pursued increasing access to advanced technology and to information. We believe this computer technology will help propel our schools into the information age by allowing users to access a variety of information sources, communicate and share information with other users, and significantly expand their knowledge base. The Internet is a tool for lifelong learning and only begins to open the door to expand your student’s education experience.

PROPER AND ETHICAL USE: Students and staff must understand and practice proper and ethical use of the Internet as a learning tool. Free World U recognizes that technology provides ways to access current information, to practice skills, and to develop reasoning and problem-solving abilities.

ONLINE SERVICES/INTERNET ACCESS: Free World U intends that the Internet and other online resources provided are to be used to support the instructional program and further student learning.

Since the Internet contains an unregulated collection of resources, Free World U cannot guarantee the accuracy of the information or the appropriateness of any material that a student may encounter. Therefore, before using Free World U’s online resources, each student and his/her parent shall indicate their acceptance of these terms by checking the appropriate box in the application for admission. This agreement shall specify user obligations and responsibilities and shall indemnify Free World U for any damages. The student and parent shall agree to not hold Free World U responsible for materials acquired by the student on the system, violations of copyright restrictions, user mistakes or negligence, or any costs incurred by users.

Parents shall supervise students using online services.

CONDITIONS AND RULES FOR USE: The purpose of the Internet is to facilitate communication in support of research and education by providing access to unique resources and an opportunity for collaborative work. To remain eligible as a user, the use of your account must be in support of and consistent with the educational objectives of Free World U.

Transmission of any material in violation of any state regulation is prohibited. This includes, but is not limited to, copyrighted material, threatening or obscene material, or material protected by trade secret.

Monitoring: Free World U reserves the right to review any material on Free World U-issued accounts and to monitor Free World U files and Internet server space in order to make determinations on whether specific uses of the network are appropriate. In reviewing and monitoring user accounts and Internet server space, Free World U shall respect the privacy of user accounts.

Network Etiquette: All users are expected to abide by the generally accepted rules of network etiquette. These include, but are not limited to, the following:

a) Be polite. Do not use abusive language in your messages to others.
b) Use appropriate language. Do not swear or use vulgarities or any other offensive language. Do not engage in activities that are prohibited by state or federal law.
c) Do not reveal your physical address, phone number, or similar information to others.
d) Note that electronic mail (e-mail) is not guaranteed to be private. Messages relating to or in support of illegal activities will be reported to the authorities and may result in loss of user privileges.
e) Do not use the network in such a way that you would disrupt the use of the network by other users.
f) All communications and information accessible via the network should be assumed to be private property.

Network Integrity: Network personnel will be granted sufficient latitude to test for network security and Web-access filtering.

No Warranties: Free World U makes no warranties of any kind, whether expressed or implied, for the service it provides. Free World U will not be responsible for any damages a user suffers, including, but not limited to, loss of data resulting from delays, no-deliveries, misdeliveries, or service interruptions caused by Free World U’s negligence or by user errors or omissions. Use of any information obtained via the Internet is at the user’s own risk. Free World U specifically denies any responsibility for the accuracy or quality of information obtained through its services. All users need to consider the source of any information they obtain and consider how valid that information may be.

Security: Security on any computer system is a high priority, especially when the system involves many users. Users must never allow others to use their passwords. Users should also protect passwords to ensure system security and their own privilege and ability to continue use.

If you feel you can identify a security problem on our system, you should notify Free World U. Do not demonstrate the problem to other users.

Do not use another individual’s account (except network personnel in system setup and maintenance functions).

Any user identified as a security risk for having a history of problems with other computer systems may be denied access to the Free World U Internet system.

Vandalism and Harassment: Vandalism and/or harassment will result in loss of user privilege.
Vandalism is defined as any deliberate attempt to harm, modify, or destroy the data of another user. This includes, but is not limited to, the uploading or creating of computer viruses.
Harassment is defined as the persistent annoyance of another user or the interference with another user’s work. Harassment includes, but is not limited to, the sending of unwanted e-mail.

Encounter of Controversial Material: Although Free World U provides a filtering system, users may encounter material that is controversial and that users, parents, teachers, or administrators may consider inappropriate or offensive. However, on a global network it is impossible to control effectively all content, and an industrious user may discover controversial material. It is the user’s responsibility not to initiate access to such material.

PENALTIES FOR IMPROPER USE:

USER: I understand and will abide by the above conditions, rules, and acceptable use agreement. I further understand that any violation of the above conditions, rules, and acceptable use agreement may be unethical and/or may constitute a criminal offense. Should I willfully commit any violation, my access privilege may be revoked and disciplinary and/or appropriate legal action may be taken.

PARENT/GUARDIAN: As the parent/guardian of the above-listed student, I have read and understand the Internet and Network User Agreement. I understand that this access is designed primarily for students under the age of 18 years, for educational purposes. I understand that Free World U is taking reasonable steps to safeguard students from inappropriate material; however, access to such material is still possible. I WILL NOT hold Free World U responsible for inappropriate materials accessed on the Internet.

Member Account Access: All members will establish personal user names and passwords. Access to the system will be limited to authorized users who log in with a valid user ID and password combination. Members are expected to maintain control and security of their login information to prevent unauthorized parties from gaining access to Free World U.

Availability: Our service is intended to be available on a 24/7/365 basis. Due to maintenance, or for other unexpected reasons, there may be periods of unavailability.

Modification of These Terms: On occasion, these terms of service may be subject to change. It is important for members to regularly review these terms to stay informed of conditions for use of this service.

Links to Third Party Sites: Free World U may contain links to third party web sites. These linked sites are not under the control of Free World U, and we are not liable for the contents of linked sites.

Submissions: All submissions shall become the property of Free World U. No submission will be subject to any reimbursement or payment by us unless previously agreed to in writing. All subscribers authorize Free World U to reuse customized courses and lesson plans entered into the Free World U system by subscribers. Such customized courses and lesson plans may be made available to other subscribers after removal of any information that could identify the individual people who created, planned, managed, participated in, or recorded results for those courses.

Restrictions on Use: As a condition of your use of Free World U, you will not use Free World U for any purpose that is unlawful or is prohibited by these terms, conditions and notices. You may not use Free World U in any manner which could damage, disable, overburden, or impair any Free World U website or interfere with any other party’s use and enjoyment of the Free World U website. You may not attempt to gain unauthorized access to Free World U, any related website, other users’ accounts, or computer systems or networks connected to Free World U, through hacking, password mining, or any other means. You may not obtain or attempt to obtain, through any means, any materials or information not intentionally made available through Free World U. Your access to Free World U may be terminated immediately, with or without notice from us, if you fail to comply with these terms and conditions.

Software Available Through Free World U: All software that is made available to view and/or use in connection with Free World U is owned or controlled by Free World U and is protected by copyright laws and international treaty provisions. The software and educational method is patent pending. Your use of Free World U software is governed by these Terms of Service. Free World U accepts no responsibility or liability in connection with any software owned or controlled by third parties.

Liability Disclaimer: Free World U and/or its respective licensors, affiliates, and suppliers make no representations about the suitability, reliability, availability, timeliness, security from malicious software, or accuracy of the information, software, products, services, and graphics contained within Free World U. All such information, software, products, services, and graphics are provided "As Is" without warranty of any kind. Free World U and/or its respective licensors, affiliates, and suppliers hereby disclaim all warranties and conditions with regard to this information, software, products, services, and graphics, including all implied warranties and conditions of merchantability, fitness for a particular purpose, workmanlike effort, title and non-infringement, except where the exclusion of implied warranty is prohibited by law.
You specifically agree that Free World U shall not be responsible for unauthorized access to or alteration of your transmissions or data, for any material or data sent or received, or for any transactions entered into through Free World U. You specifically agree that Free World U is not responsible for any content sent using and/or included in Free World U by any third party. You further agree that Free World U and/or its respective licensors, affiliates, and suppliers may make improvements and/or changes to Free World U and/or may discontinue any part of Free World U at any time.
In no event shall Free World U and/or its respective licensors, affiliates, and suppliers be liable for any direct, indirect, punitive, incidental, special, or consequential damages or any damages whatsoever including, without limitation, damages for loss of use, data, or profits, arising out of or in any way connected with the use or performance of Free World U, or for any information, software, products, services, or graphics obtained through Free World U, whether based on contract, tort, negligence, strict liability, or otherwise, even if Free World U or any of its suppliers has been advised of the possibility of damages, except where the exclusion or limitation of liability for consequential or incidental damages, is prohibited by law.

Course content: Free World U will perform data entry for course materials that you have legally acquired. By accepting these Terms of Service, you are indicating that you accept responsibility for complying with any copyright or proprietary usage restrictions from content providers. Free World U limits its role to entering data from materials which you have legally acquired and which you have explicitly requested Free World U representatives to enter on your behalf into your privately accessible and secure portion of the web application database.

Personal and Non-Commercial Use: This service is for your personal, non-commercial use only. You may not copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative work from, transfer, or sell any information, software, or products obtained from Free World U without prior written consent.

Cancellation: You may cancel your registration to Free World U by checking the appropriate box in the Account section. The cancellation will go into effect at the end of the current month and not be prorated to the day. Free World U reserves the right to terminate your access to Free World U or any portion thereof at any time, without notice.

General: These terms and conditions are governed by the laws of the State of California, without respect to its conflict of laws principles. Jurisdiction for any claims arising under this agreement shall lie exclusively with the state or federal courts within Los Angeles County, California. The U.N. Convention of Contracts for the International Sale of Goods is expressly excluded from any interpretation of this Agreement. If any provision of these terms and conditions are found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these terms and conditions, which shall remain in full force and effect. No waiver of any term of these terms and conditions shall be deemed a further or continuing waiver of such term or any other term. These terms and conditions constitute the entire agreement between you and Free World U. No changes to these terms and conditions shall be made except by a revised posting on this page.
